Adults 21 and over

Under the Cannabis Regulation Act, adults 21 and over may buy and carry, in public, up to:

● 2 ounces of cannabis flower
● 16 grams of cannabis concentrate or extract
● 800 milligrams of THC in edibles

There is no state limit on how much you can keep at home, as long as it is stored out of public view.

Medical patients

Qualified patients and their primary caregivers can buy up to 425 units of medical cannabis in a rolling 90-day period, and the Online Patient Portal shows how many units you have left. Visiting patients from other states get the same 425-unit limit through reciprocity. If your condition needs more, your medical provider can ask the Department of Health to raise your limit. See New Mexico Medical Cannabis Program to get a card.

Growing at home

Adults 21 and over may grow up to six mature plants per person, with no more than 12 mature plants per household. Plants must be kept out of public view. Medical patients can also apply to the Department of Health for a Personal Production License.

Where you can’t use cannabis

● In public places, including parks, sidewalks and trails
● In a vehicle, whether you are the driver or a passenger
● On school grounds, in a school bus or at a youth center
● At work, unless your employer allows it
● On federal land, such as national forests and monuments

Driving while impaired by cannabis is illegal, just as with alcohol. Taking cannabis across state lines is a federal crime, even into another legal state.

What the Compassionate Use Act protects

The Lynn and Erin Compassionate Use Act protects qualified patients, primary caregivers, practitioners and licensed producers from arrest, prosecution or penalty for the medical use of cannabis within the program’s limits. Patients and caregivers get those protections by carrying their registry identification card. The protections don’t cover driving under the influence, use on school grounds or in public places, or false claims about being a patient.
